ความรับผิดชอบของรัฐและธุรกิจต่อการเปลี่ยนแปลงสภาพภูมิอากาศในบริบทของสิทธิมนุษยชน

บทคัดย่อ

เป็นที่ยอมรับในปัจจุบันว่าผลกระทบของการเปลี่ยนแปลงสภาพภูมิอากาศมีความสัมพันธ์กับสิทธิมนุษยชน บทความนี้มุ่งศึกษาความรับผิดชอบของรัฐและธุรกิจต่อการเปลี่ยนแปลงสภาพภูมิอากาศในประเด็นของสิทธิมนุษยชน จากการศึกษาพบว่าภายใต้ระบอบกฎหมายการเปลี่ยนแปลงสภาพภูมิอากาศ นอกจากรัฐมีพันธกรณีในการลดการปล่อยก๊าซเรือนกระจกแล้ว ในประเด็นสิทธิมนุษยชนรัฐยังมีความรับผิดชอบในการปกป้องสิทธิมนุษยชนที่เกิดจากการเปลี่ยนแปลงสภาพภูมิอากาศที่ถูกทำลายด้วย สำหรับความรับผิดชอบของธุรกิจต่อการละเมิดสิทธิมนุษยชนนั้นพบว่าได้มีการยอมรับในปัจจุบัน แต่ความรับผิดชอบของธุรกิจต่อการเปลี่ยนแปลงสภาพภูมิอากาศนั้นยังไม่ชัดเจน สำหรับการทำให้กฎหมายมีผลใช้บังคับนั้นพบว่าได้มีความพยายามของภาคประชาสังคมที่ฟ้องบริษัทเอกชนให้รับผิดพร้อมเรียกร้องค่าสินไหมทดแทนต่อการปล่อยก๊าซเรือนกระจกผ่านกลไกทางศาล และในกลไกอื่นนอกจากศาล พบว่าคณะกรรมการสิทธิมนุษยชนแห่งชาติของบางประเทศได้ประกาศให้ตนเองมีหน้าที่ในการไต่สวนและตรวจสอบการละเมิดสิทธิมนุษยชนที่เกี่ยวข้องกับการเปลี่ยนแปลงสภาพภูมิอากาศด้วย
