Legal problems on the Securitization of Thai Asset Management Corporation

Abstract

In this research, the researcher has the following objective: 1) To study and understand the concept of establishing The Thai Asset Management Corporation according Emergency Decree on The Thai Asset Management Corporation B.E. 2544. 2) Conducting a comparative study of the criteria of securitization process in accordance with the Royal Enactment on special purpose vehicle for securitization B.E. 2540 with the criteria for securitization in the management of non-performing assets of Korea (KAMCO) and Mexico (FOBAPROA). 3) Analyze problems that may arise from the law that does not require the Thai Asset Management Corporation to use the securitization process to manage non-performing assets, debt restructuring and business restructuring. 4) Proposing solutions and finding suitable solutions for solving problems encountered in the management of non-performing assets in accordance with Emergency Decree on the Thai Asset Management Corporation B.E. 2544 to effective in order to promote debt restructuring and rehabilitation under the bankruptcy law. In this research, qualitative research was conducted through documentary research. The result was as follows: Thai Asset Management Corporation should convert assets into securities.
