บทบาทของข้าราชการระดับสูง และการเมืองในการขยายตัวของระบบราชการในประเทศไทย: กรณีศึกษากระทรวงยุติธรรม

บทคัดย่อ

               ผู้เขียนมองว่าผู้ที่ได้ผลประโยชน์จากการปฏิรูประบบราชการมากที่สุดคือข้าราชการระดับสูง ซึ่งเข้าไปมีส่วนร่วมในกระบวนการปฏิรูประบบราชการเพื่อรักษาผลประโยชน์ของตนเองไว้ การศึกษาครั้งนี้จึงต้องการตอบคำถามว่า ข้าราชการระดับสูงใช้วิธีการอะไรในการรักษาผลประโยชน์ของตน พร้อมทั้งอธิบายปัจจัยฐานอำนาจที่สนับสนุนให้ข้าราชการระดับสูงได้รับประโยชน์จากการขยายระบบราชการให้ใหญ่ขึ้นได้

               การศึกษาครั้งนี้ใช้การขยายโครงสร้างระดับกรมของกระทรวงยุติธรรมในช่วง พ.ศ. 2545 - 2553 เป็นกรณีศึกษา ซึ่งกรณีดังกล่าวเป็นตัวอย่างที่แสดงให้เห็นถึงชัยชนะของข้าราชการในการขยายตัวของระบบราชการไทย โดยวิธีการเก็บข้อมูลที่ใช้คือ การสัมภาษณ์เชิงลึก และการวิจัยเอกสาร

               ผลการศึกษาพบว่าการขยายตัวของระบบราชการนั้นทำให้เกิดตำแหน่งบริหารระดับสูงจำนวนมาก ซึ่งข้าราชการระดับสูงต้องการจะดำรงตำแหน่งหลังการปฏิรูปเสร็จสิ้น ตำแหน่งระดับสูงที่เกิดขึ้นใหม่ดังกล่าวนี้มาพร้อมกับผลประโยชน์ทั้งที่เป็นทางการและไม่เป็นทางการ ซึ่งถูกกำหนดไว้ก่อนหน้าการปฏิรูปแล้ว เพื่อให้ได้ในสิ่งที่ตนต้องการ ข้าราชการระดับสูงจึงใช้วิธีการที่แตกต่างกันไปขึ้นอยู่กับการสนับสนุนของนักการเมืองที่มาจากการเลือกตั้ง อย่างไรก็ตาม วิธีการที่สำคัญที่สุดคือการเข้าไปอยู่ในตำแหน่งที่รับผิดชอบการปรับปรุงโครงสร้างหรือการปฏิรูประบบราชการอย่างเป็นทางการ ซึ่งข้าราชการระดับสูงผู้ที่ได้ชัยชนะตามที่ตนเองต้องการนั้นต้องมีต้นทุนส่วนบุคคล ทั้งประสบการณ์ที่เกี่ยวข้อง และเครือข่ายสายสัมพันธ์กับฝ่ายบริหารและฝ่ายการเมือง และสภาพแวดล้อมนโยบายจะต้องสนับสนุนด้วย 

 

Abstract

            The author argues that the major beneficiaries of administrative reform in Thailand are high public officials who get most from the reform. The high public officials are driven by self-interests when they carry out reform. This study shows how high public officials manipulate the reform process to meet their own interests, and explains the factors that enable them to gain from administrative reform policies such as “big government.” 

The expansion of departments in the Ministry of Justice during 2001 – 2010, representing efforts to expand the bureaucracy is used to be a case study to illustrate the argument. In-depth interviews and documentary research were used to gather information.

               The study found that bureaucratic expansion was carried out because of gains from new administrative positions that high public officials will get after reform. These new high positions come with lucrative rewards both formal and informal.  High public officials employ different strategies to get what they want depending on the level of support from political bosses. However, the strategies can be used effectively when the high public officials assumed an official position in charge of bureaucratic reform. The key factors for success that enable high public officials to become winners are personal background and experience, and political and bureaucratic patronage and reform environmental support.
