แนวทางการพัฒนากฎหมายการศึกษาเพื่อการบริหารจัดการศึกษา ในเขตพัฒนาเศรษฐกิจพิเศษ

Abstract

          งานวิจัยชิ้นนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาแนวทางการพัฒนากฎหมายการศึกษาเพื่อการบริหารจัดการการศึกษาในเขตพัฒนาเศรษฐกิจพิเศษ และข้อเสนอการปรับปรุงกฎหมายการศึกษา  2) กำหนดรูปแบบการบริหารจัดการการศึกษาในเขตพัฒนาเศรษฐกิจพิเศษ และ 3) ร่างกฎหมายเพื่อการบริหารจัดการการศึกษาในเขตพัฒนาเศรษฐกิจพิเศษ  โดยทำการศึกษา ครอบคลุมพื้นที่เขตพัฒนาเศรษฐกิจพิเศษ จำนวน 10 เขต มีเนื้อหาครอบคลุมการศึกษาตลอดชีวิต ทั้งการศึกษาในระบบ การศึกษานอกระบบ การศึกษาตามอัธยาศัย ทั้งนี้กำหนดประชากร กลุ่มตัวอย่าง ผู้ให้ข้อมูลสำคัญที่ใช้ในการศึกษาในครั้งนี้ ได้แก่ นักปราชญ์ นักคิด ผู้เชี่ยวชาญหรือผู้ทรงคุณวุฒิทางด้านการศึกษา กฎหมาย และการกระจายอำนาจ ตลอดจนผู้ที่เกี่ยวข้องกับการศึกษาในพื้นที่เขตพัฒนาเศรษฐกิจพิเศษ จำนวน 10 เขต โดยมีวิธีการวิจัยแบบผสมผสานทั้งเชิงปริมาณ และคุณภาพ (Mixed Method) โดยทำการตรวจสอบความเหมาะสมของแนวทางการพัฒนากฎหมายการศึกษาเพื่อการบริหารจัดการการศึกษาในเขตพัฒนาเศรษฐกิจพิเศษ และข้อเสนอการปรับปรุงกฎหมายการศึกษา ด้วยการวิจัยเชิงปริมาณโดยใช้แบบสอบถามความคิดเห็นคณะกรรมการนโยบายเขตพัฒนาเศรษฐกิจพิเศษ (กนพ.) และคณะกรรมาธิการขับเคลื่อนการปฏิรูปประเทศด้านการศึกษา

          ผลการวิจัยพบว่า 1) การจัดการศึกษาของเขตพัฒนาเศรษฐกิจพิเศษจะต้องสามารถแก้ไขปัญหาและตอบสนองความต้องการของประชาชน และผู้ประกอบการในเขตพัฒนาเศรษฐกิจพิเศษ 2) ความมุ่งหมายของการจัดการศึกษาของเขตพัฒนาเศรษฐกิจพิเศษมี 3 ด้าน ได้แก่ ด้านผู้เรียน ด้านสังคม ด้านสาระการเรียนรู้และกระบวนการเรียนรู้ โดยความมุ่งหมายด้านผู้เรียนมุ่งเน้นการพัฒนาคุณภาพคนให้มีความสมบูรณ์อย่างรอบด้าน การจัดการศึกษาของเขตพัฒนาเศรษฐกิจพิเศษต้องยึดศักยภาพของผู้เรียนเป็นสำคัญ โดยกระบวนการจัดการศึกษาต้องส่งเสริมให้ผู้เรียนได้รับการพัฒนาเต็มตามศักยภาพเพื่อสู่ความเป็นเลิศตามอัจฉริยภาพของตนเอง 3) กระทรวงศึกษาธิการมีอำนาจหน้าที่ในการส่งเสริม และกำกับดูแลการศึกษาทุกระดับและทุกประเภทของเขตพัฒนาเศรษฐกิจพิเศษ ตลอดจนสนับสนุนทรัพยากรเพื่อการศึกษา และติดตาม ตรวจสอบ และประเมินผลการจัดการศึกษาและราชการอื่นตามที่มีกฎหมายกำหนดให้เป็นอำนาจหน้าที่ของกระทรวง โดยกำหนดให้มีคณะกรรมการบริหารศูนย์การบริหารจัดการศึกษาในเขตพัฒนาเศรษฐกิจพิเศษที่มีลักษณะที่เป็นพหุภาคี
