Abstract

As the law on sale in Thailand has no specific provisions on remedies available to the buyer in the case where the seller has delivered the goods which are defective or fail to be in conformity with contractual requirements, the buyer therefore resorts to remedies available under general provisions in the law of obligations. Such resort of traditional remedies leads to inadequate compensation and may also result in unreasonable burdens on the part of the buyer despite
the absence of his fault. As such, certain specific provisions setting out additional remedies should be inserted into the law. One of new remedies suggested is the right to reduce the price.
