The Reform of Professional Media Organizations in Compliance with the Guidelines Stipulated in the Constitution Law of the Kingdom of Thailand

Abstract

The reform of the professional media organizations as stipulated in the present Constitutional Law of the Kingdom of Thailand has given rise to severed legal problems arising from the enforcement of the Constitution Law, particularly certain effects upon the performance of the professional media. There are also problems related to the ethics of the professional media organizations, and the problems related to the appeal of disciplinary actions imposed on the professional media. Consequently, the above-mentioned problems have affected the confidence and the performance of the professional media. Therefore, the reform of the professional media organizations as stipulated in the present constitutional law of Thailand is not in agreement with the principle of the legality of state action. As a result, the Constitution Law cannot protect the rights and liberties of the professional media, although it provides for the protection of the rights and liberties of the people in general. The provision of mechanisms for the enforcement of Constitution Laws in foreign countries as a universal standard to protect the rights and liberties of the professional media, should be applied in Thailand by providing a clear description of the scope of the rights and liberties of the professional media that cannot be violated. Recommendations for solving the legal problems related to the professional media arising in Thailand congruent to the Thai legal process were also provided.
