The Model of Carita Application to the Mediation of Mediators in the Court of Justice

บทคัดย่อ

This thesis in form of a qualitative-field research done by the tools of documentary study and an in-depth interview with 7 key informants, is of 3 objectives: (1) to study litigants in mediation of the Court of Justice, (2) to study the Six Carita in Theravada Buddhist Scripture, and (3) to present the model of Carita application to mediators’ mediation in the Court of Justice.

From the research, it is found the followings:  1) The analysis of litigants in mediation of the Court of Justice is developed from experiences that turned to be theories under the law in studying litigants and finding the mediating means that suits each person. 2) The study of the Six Carita in Theravada Buddhist Scripture found the differentiation of personalities and characters of persons into 6 Carita or characteristic behaviors, together with the explanation of the meanings, characters and the proper means to suit with each person in each of characteristic behavior. 3) The Six Carita can be brought to use as basic mediation since it is the variable the mediators cannot overlook because it shows the litigants’ behaviors; the mediation that suits each person’s Carita will support it to the success and lead to the creation of a model of the Six Carita for mediation through the measure of Carita and the means of mediation based on the Six Carita.
