The Right to Healthy Environment in Constitution of Thailand: Comparing Law with Foreign Countries

Abstract

The Right to Healthy Environment? What does it mean? What is its definition? This study will show that the right to environment is the right involving with natural resources and environment that everybody deserves it. This right cannot be divided and is attached with individual since they were born. It can be categorized as substantive rights and procedural rights. The study found that the right to environment in Thailand had been set out in many constitutions in the past but not comprehensively consolidated in the 2017 constitution, because the enactment of organic laws or acts is subsequently required. Moreover, as of 2012 it has been found in the foreign constitutions both of the substance rights and procedural rights are legally recognized in more than 177 of 193 the UN member nations.
