Legal Analysis of the Criminal Liability of Children and Juveniles

Abstract

This research aim to (1) study problems are criminal liability of juvenile in Thailand, (2) study problems are criminal liability of juvenile’s parent in Thailand, (3) study for compare are criminal liability of juvenile in Thailand, and (4) study for improving law of criminal liability by juvenile’s recidivism.


Findings are as follows:


1. The problem of criminal liability of juvenile in Thailand found that juvenile delinquency were increased strongly. In part of penal code are not unsuitable for juvenile delinquency and problem.


2. The problem of criminal liability of juvenile’s parent found that the parent should be instruct and collective responsibility.


3. Result of compared Thai’s law with international’s law in penal code have same and different.


4. The revision of statutes guide in criminal liability of juvenile that recidivism found that penal code for juvenile are unsuitable and conform with problem at offender are not reverence in law and recidivism.
