กฎหมายห้ามสูบบุหรี่ระหว่างประเทศใน AEC และอัตราการสูบบุหรี่

Abstract

การสูบบุหรี่เป็นปัจจัยเสี่ยงหลักของโรคไม่ติดต่อเรื้อรังซึ่งเป็นสาเหตุสำคัญของการเสียชีวิตที่สูงที่สุดของคนทั่วโลก ที่ประชุมของ WHO Framework Convention on Tobacco Control (WHO FCTC) ได้นำเสนอแนวทางปฏิบัติต่อองค์การอนามัยโลก เพื่อให้ประเทศสมาชิกรับไปกำหนดมาตรการให้ประชาชนสูบบุหรี่หรือได้รับสัมผัสควันบุหรี่ให้น้อยลงได้แก่การกำหนดสถานที่ห้ามสูบบุหรี่ (FCTC Article 8); การโฆษณา การส่งเสริมการขายและสนับสนุนกิจกรรม (FCTC Article 13); บรรจุภัณฑ์และการติดฉลาก (FCTC Article 11) ประเทศไทยและประเทศต่างๆ ใน ASEAN Economic Community (AEC) ในฐานะที่เป็นสมาชิกขององค์การอนามัยโลกได้ยอมรับข้อตกลงนี้มาปฏิบัติ

บทความนี้นำเสนอความหลากหลายของกฎหมายควบคุมการบริโภคยาสูบของประเทศต่างๆ ใน AEC ได้แก่ ประเทศไทย อินโดนีเซีย กัมพูชา สาธารณรัฐประชาธิปไตยประชาชนลาว ฟิลิปปินส์ มาเลเซีย เวียดนาม เมียนมาร์ สิงคโปร์ บรูไน และเปรียบเทียบกับอัตราการสูบบุหรี่ของประชากรในแต่ละประเทศเหล่านั้นพบว่าทุกประเทศใน AEC เข้าเป็นสมาชิกของ WHO FCTC ยกเว้น อินโดนีเซีย และเป็นประเทศที่มีสัดส่วนประชากรสูบบุหรี่มากที่สุด ทั้งประเภทสูบในปัจจุบันและสูบเป็นประจำ รองลงมาเป็น ฟิลิปปินส์ และลาว ตามลำดับ ส่วนประเทศที่มีสัดส่วนน้อยที่สุด คือ บรูไน สิงคโปร์ เมียนมาร์ ทุกประเทศใน AEC มีกฎหมายเกี่ยวกับการควบคุมยาสูบ แต่มีรายละเอียดที่แตกต่างกันสำหรับประเทศไทยนั้นเมื่อเปรียบเทียบความเข้มงวดของกฎหมายจะถือว่าเป็นประเทศที่มีกฎหมายเข้มงวดมากกว่าประเทศอื่นๆ ในด้านการประกาศสถานที่ห้ามสูบบุหรี่ การโฆษณาประชาสัมพันธ์และการควบคุมการออกแบบผลิตภัณฑ์บุหรี่

 

International Law on Smoking Bans in the AEC and Smoking Prevalence Rate

Smoking is the major risk of communicable diseases which are primary cause of death of population around the world. WHO Framework Convention on Tobacco Control (WHO FCTC) introduced guidelines for implementation to WHO; aiming to member countries to adopt for setting up laws and regulations to control tobacco consumption. The measures are Smoke Free Places (FCTC Article 8); Tobacco Advertising, Promotion and Sponsorship (FCTC Article 13); and Tobacco Packaging and Labeling (FCTC Article 11). Thailand and countries among ASEAN Economic Community (AEC), as WHO member, adopted the guidelines.

This article reports the diversity of laws and regulations regarding control of tobacco consumption in Thailand, Indonesia, Cambodia, Laos, Philippines, Malaysia, Vietnam, Myanmar, Singapore and Brunei. Smoking prevalence of these countries was compared. It was found that all countries in AEC are WHO FCTC members except Indonesia. And the proportion of smoking population in Indonesia is the highest, both daily and current smoking. The second and third ranks are Philippines and Laos PDR respectively, while Brunei, Singapore and Myanmar are the least three. However all AEC countries have tobacco control laws but different in details. Thailand has strong laws to control tobacco consumption in comparison to other countries; either in smoking free area, advertisement, or control on package design.
