Abstract

ผู้ป่วยจิตเวชหรือผู้ที่มีความผิดปกติทางจิตถือเป็นบุคคลผู้ที่มีโอกาสก่อให้เกิดอันตรายทั้งต่อชีวิต ร่างกาย เสรีภาพ ตลอดจนทรัพย์สิน ทั้งของตนเองและผู้อื่น   เมื่อบุคคลดังกล่าวได้กระทำความผิดทางอาญาจะมีผลทางกฎหมายตามประมวลกฎหมายอาญา ซึ่งมีกระบวนพิจารณาเป็นการเฉพาะ  โดยระดับความรับผิดทางอาญาจะพิจารณาจากระดับความไม่รู้ผิดชอบ หรือความรู้ผิดชอบที่ต่างกัน  ดังนั้น การศึกษาความรับผิดทางอาญาของผู้ป่วยจิตเวช จึงเป็นประโยชน์อย่างยิ่งที่จะทำให้ทราบถึงหลักเกณฑ์และวัตถุประสงค์ของกฎหมาย  ปัญหาที่เกิดขึ้นในปัจจุบันเกี่ยวกับการดำเนินคดีอาญาคือความเข้าใจที่ไม่ตรงกันระหว่างจิตแพทย์กับนักกฎหมายรวมทั้งสื่อมวลชนด้วยเกี่ยวกับอาการทางจิตเวชของผู้ป่วยในแต่ละกรณี ซึ่งส่งผลโดยตรงในการใช้มาตรการทางกฎหมายทั้งในประมวลกฎหมายอาญา และประมวลกฎหมายวิธีพิจารณาความอาญาคลาดเคลื่อนไปด้วย ดังนั้นบุคลากรในกระบวนการยุติธรรมไม่ว่าจะเป็นตำรวจ พนักงานอัยการ ศาล ควรจัดสัมมนาร่วมกับกรมสุขภาพจิตกระทรวงสาธารณสุข เพื่อทำความเข้าใจร่วมกัน  เพื่อนำมาซึ่งการกำหนดมาตรการในการดูแลและควบคุมผู้ป่วยจิตเวชให้เป็นไปอย่างเหมาะสม  เพื่อดูแลผู้ป่วยจิตเวชให้เกิดความปลอดภัยทั้งผู้ป่วยจิตเวชเองและปลอดภัยกับสังคมโดยส่วนรวม

Psychiatric patients or the persons who suffer from mental illness are regarded as those who were likely to commit violence against the life, body, liberty or property of the compelled person or a third person.  When the psychiatric patients committed criminal crime, they received legal consequences according to the Criminal Code which had exceptional procedure.  In other words, the level of criminal liability relied on the different level of doli incapax or doli capax.  Therefore the study of criminal liability of the psychiatric patients must be useful in order to be aware of the criteria and the objectives of the law.  The problems occurred at present was the disagreement for the criminal prosecution of psychiatrists, lawyers, and mass communications persons about the psychiatric symptoms of the psychiatric patients of each case.  As a result, such disagreement affected the use of legal measure both in the Criminal Code and the Criminal Procedure Code and caused error in the criminal prosecution.  Thus, the persons involved in the justice process, these were policemen, public prosecutors, and clerks to the justice should set up a seminar with the officers from the Mental Health Department, Ministry of Public Health to come up with the same opinion and to take care of the psychiatric patients for their safety and for the safety of people in general.
